Terms of Sale

 (1)      Introduction

Please read these terms of sale carefully.

You will be asked to expressly agree to these terms of sale before you place an order for products from our website.

 

(2)      Interpretation

In these terms of sale, “we” means Dotty Bobbin “us” and “our” will be construed accordingly; and “you” means our customer or potential customer for products (and “your” will be construed accordingly).

 

(3)      Order process

The advertising of products on our website constitutes an “invitation to treat”; and your order for products constitutes a contractual offer.  No contract will come into force between you and us unless and until we accept your order in accordance with the procedure detailed below.

In order to enter into a contract to purchase products from us, you will need to take the following steps:

We will not file a copy of these terms of sale specifically in relation to your order.  We may update the version of these terms of sale on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible.  We therefore recommend that you download, print and retain a copy of these terms of sale for your records.

The only language in which we provide these terms of sale is English.

 

(4)      Price and payment

Prices for products are quoted on our website.  The website contains a large number of products and it is always possible that some of the prices on the website may be incorrect.  We will verify prices as part of our sale procedures so that a product’s correct price will be stated when you pay for the product.

In addition to the price of the products, you may have to pay a delivery charge, which will be as stated when you pay for the product.

Payment must be made upon the submission of your order.  We may withhold the products and/or cancel the contract between us if the price is not received from you in full in cleared funds.

We  will accept cash on the day for our sewing classes/courses. However, please be aware that should you make a booking for a class or course and fail to attend you will still be liable for  payment unless you inform us outside of the minimum notice period  outlined below.

The minimum notice period required for cancellation is 48 hours before the start time of the scheduled class/course.

(5)      Your warranties

You warrant to us that:

(a)      you are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these terms of sale;

(b)      the information provided in your order is accurate and complete; and

(6)      Delivery policy

We will arrange for the products to be delivered to the address for delivery indicated in your order.

We will use reasonable endeavours to deliver products on or before the date for delivery set out in our order confirmation or, if no date is set out in our order confirmation, within 5 working days of the date of our order confirmation.

 

(7)      Consumers: returns policy

 

This Section applies to consumers, not business customers.

Under the Distance Selling Regulations, you may cancel a distance contract to purchase a product or products from us at any time within 7 working days after the day you received the relevant products or products (subject to the limitations set out below).

In order to cancel a contract in this way, you must give to us written notice of cancellation.

[You will not have any such right insofar as a contract relates to: (i) the supply of any products which constitute audio or video recordings or computer software which have been unsealed by you; (ii) the supply of products the price of which is dependent upon fluctuations in financial markets which we cannot control; (iii) the supply of newspapers, periodicals or magazines; (iv) the supply of goods made to your specifications or clearly personalised; or (v) the supply of goods which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.]

If you cancel a contract on this basis and you do not return the products to us, we may recover the products and charge you for the costs we incur in doing so.  Similarly, if you return the products at our expense, we may pass that expense on to you.

 

(8)      Consumers: statutory rights

 

If you are a consumer, any statutory rights which you have, which cannot be excluded or limited, will not be affected by the terms of sale.

 

(9)      Refunds

Please refer to Dotty Bobbin Returns Policy below.

 

(10)    Contract cancellation

We may cancel a contract to supply products made under these terms of sale immediately by written notice to you if you fail to pay, on time and in full, any amount due to us under the contract, or commit any material breach of your obligations to us under the contract.

 

(11)    Consequences of cancellation

Upon the cancellation of a contract in accordance with Section (10):

we will cease to have any obligation to deliver products which are undelivered at the date of cancellation;

 

(12)    Scope of these terms of sale

These terms of sale do not constitute or contain any assignment or licence of any intellectual property rights, do not govern the licensing of works (including software and literary works) comprised or stored in products, and do not govern the provision of any services by us or any third party in relation to the products.

 Dotty Bobbin Returns Policy

(1)      Introduction

We understand that from time to time you may wish to return a product to us.

We have created this 30 day returns policy to enable you to return products to us in appropriate circumstances.

 

(2)           Returns

Where you have no other legal right to return a product and receive a refund or exchange, then you will nonetheless be entitled to return a product to us where:

(a)            we receive the returned product within 30 days following the date of purchase of the product;

(b)            the returned product is unused, in its original packaging, with any labels still attached, and otherwise in a condition enabling us to sell the product as new;

 

(3)           Returns procedure

In order to take advantage of your rights under this returns policy, you must: suitably package the item and return it in person or by post to:

(4)           Exclusions

The following kinds of products may not be returned under this policy:

(a)            Tailor made or personalised products. Should there be a fault with such a product please email us at saskia@dottybobbin.co.uk

 

(5)           Refunds

We will give you a refund for the full price of any product properly returned by you in accordance with the terms of this returns policy including the original delivery charges and excluding the costs of returning the product to us.

 

(6)           Improper returns

Where you return a product in contravention of this policy (and where you do not have any other legal right to return the product):

(a)            we will not refund or exchange the product;

(b)            we may retain the returned product until you pay to us such additional amount as we may charge for re-delivery of the returned product

 

Safety Rules

These safety rules are designed for a responsible parent to discuss with their child. Please ensure that you understand and are happy with what is expected of your child.

1)    Mums or Dads to be in attendance for all children under 8 years old

2)    Fingers to be kept clear of running needles on the sewing machines

3)    Scissors to be handled with care, no walking around with them

4)    Iron is only to be operated with an adult supervising one to one

5)    No running around

6)    If you are unsure stop, take your foot off the pedal and ask!

7)    Don’t thread the machine unless the machine is switched off to avoid sewing your finger!

 

Disclaimer

1) To the best of my knowledge there is no reason for which I or my child(ren) are unable to operate the sewing machinery and equipment safely under group supervision.

2) I have made the organiser aware of all and any circumstances, disabilities and conditions which may render me or my child(ren) unable to use the machinery without parental supervision.

3) I undertake that I will and my child(ren) will conduct himself (herself) (themselves) in a manner appropriate to the safe conduct of the activities. I understand that, should I or my child(ren) fail to conduct himself (herself) (themselves) in accordance with the safety rules , myself, or my child(ren) shall be excluded from the activities without refund.

I understand that the organiser, having taken all reasonable steps to ensure the safety of myself and/or my child(ren)in pursuance of the activities, shall accept no liability for any harm or injury caused by my child(ren) to himself (themselves) (herself) where such injury is owing to:

(a) Any such condition, disability or circumstance pertaining to myself or my child(ren) which may render me (him) unable to safely use the equipment, of which the organiser has not been made aware in pursuance of clause (2).

(b) Any such conduct that does not conform to the safety rules which are available on the website www.dottybobbin.co.uk, of which I have given an undertaking in clause (3)

Sewing and craft activities carry a risk. Your fingers and your child’s fingers are your own responsibility. Please follow our safety guidelines to avoid injury. Dotty Bobbin cannot be held liable for any injuries sustained.
